Terms of Service

These Terms limit Manitoba CareMatch's liability and include an indemnity clause. Please read carefully before using the platform.
1. Acceptance of Terms
By accessing and using Manitoba CareMatch ("the Platform"), you agree that you have read, accept, and will comply with these Terms of Service ("Terms"). These Terms are a legal agreement between you and Manitoba CareMatch. If you do not agree, you may not use the Platform.
2. About The Platform
Manitoba CareMatch is an online marketplace connecting healthcare workers with facilities that need qualified staff. The Platform facilitates shift posting, qualification matching, shift claiming, scheduling, messaging, and payment processing. Manitoba CareMatch is not itself a healthcare provider and is not a party to service contracts between workers and employers.
3. Account Registration
You must register and create an account to access platform features. You may only maintain one active account. You agree to provide accurate information during registration and keep it current. We reserve the right to refuse or terminate any registration at our discretion.
4. Account Security
You are responsible for maintaining the confidentiality of your password and for all activities that occur under your account. Notify us immediately of any unauthorized use. We are not liable for any loss arising from unauthorized access to your account.
5. User Roles
The Platform supports three user roles:
- Workers — Healthcare professionals who browse and claim shifts.
- Employers — Healthcare facilities or organizations that post shifts and manage staffing.
- Administrators — Platform administrators who oversee operations, compliance, and user management.
6. Shift Claiming & Compliance
Shift claiming is subject to real-time qualification matching. Workers may only claim shifts for which they hold valid, unexpired certifications. The Platform enforces compliance automatically — workers with expired or missing certifications will be blocked from claiming affected shifts. All shift claims use database-level transaction locking to prevent double-booking.
7. Certification Requirements
Workers are responsible for maintaining current and valid professional certifications. The Platform tracks certification expiry dates and provides advance notifications. Workers must upload and maintain accurate certification records. Providing false or misleading certification information is grounds for immediate account termination.
8. Code of Conduct
All users agree not to:
- Provide false, misleading, or fraudulent information
- Impersonate another person or misrepresent qualifications
- Harass, threaten, or discriminate against other users
- Use the Platform for any unlawful purpose
- Attempt to circumvent the Platform's payment or booking systems
- Scrape, crawl, or collect data from the Platform without authorization
- Interfere with or disrupt the Platform's operation
- Attempt to probe, test, or breach the Platform's security
9. Payments
All payments between employers and workers are facilitated through the Platform. Employers agree to pay for completed shifts through the Platform's payment system. Workers receive direct deposits for completed work. Platform service fees may apply and will be clearly communicated. Users are solely responsible for their tax obligations.
10. Background Checks
We encourage all workers to complete Criminal Record Checks, Vulnerable Sector Checks, and Child Abuse Registry Checks. Employers are encouraged to request verification of these checks. The Platform may facilitate these checks but does not warrant or guarantee results.
11. Intellectual Property
The Platform, including all software, design, content, trademarks, and associated intellectual property, is the exclusive property of Manitoba CareMatch and its licensors. You may not reproduce, modify, distribute, or create derivative works without written permission.
12. Limitation of Liability
To the maximum extent permitted by law, Manitoba CareMatch shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, loss of data, or loss of goodwill, arising from your use of the Platform. Our total liability shall not exceed the fees you have paid in the six months preceding the event giving rise to liability, or $150 CAD, whichever is greater.
13. Indemnification
You agree to indemnify and hold harmless Manitoba CareMatch, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from your use of the Platform, your content, or your interactions with other users.
14. Account Termination
You may cancel your account at any time by contacting support@carematch.ca. We may suspend or terminate your account for violation of these Terms, fraudulent activity, or at our discretion. Upon termination, your right to use the Platform ceases immediately.
15. Dispute Resolution
Any disputes arising under these Terms shall first be subject to informal negotiation. If unresolved, disputes shall be submitted to mediation in Winnipeg, Manitoba. If mediation fails, disputes shall be resolved through binding arbitration under the laws of the Province of Manitoba.
16. Changes to Terms
We may modify these Terms at any time. Material changes will be communicated via email or platform notification. Continued use of the Platform after changes constitutes acceptance of the updated Terms.
17. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of Manitoba and the applicable laws of Canada. You irrevocably submit to the jurisdiction of the courts of Manitoba.
